Terms of Sale
1. Contact and Ordering Process
Kunstsamlingen does not trade in artworks. We only act as a facilitator between the artist and the buyer. If you have questions regarding these terms (including technical inquiries), you can contact Kunstsamlingen’s customer service at the designated email.
Visit Kunstsamlingen’s website and select an artwork. Use the "Buy direct from the artist" button to contact the artist. When you contact the artist, it represents an offer to purchase from the artist. Kunstsamlingen is not a party to the transaction. All agreements on payment, invoicing, delivery, returns, and complaints are handled directly with the artist.
2. Product Information
We strive to show accurate availability, but artworks may already be sold. The artist reserves the right to make changes or reject an order if the work is no longer available.
3. Pricing
All prices are listed in DKK. Shipping is not included in the price and is agreed upon directly with the artist. If a pricing error occurs, the artist will contact you. Neither Kunstsamlingen nor the artist is obliged to complete the sale at an obviously incorrect price.
4. Payment
Payment is made directly to the artist. Kunstsamlingen does not handle payments and is not part of the financial transaction.
5. Shipping
Once the artist has received payment, they will ship the artwork. The risk transfers to you on the day you receive the item. Any transport damage must be noted immediately and reported to the artist. Pickup from the artist is possible by agreement.
6. Right of Withdrawal (Returns)
You have a 14-day right of withdrawal, according to Danish law. The period starts when you receive the item. The artwork must be returned in the same condition. Return costs are borne by the buyer and are not refundable.
Withdrawal and refund processing must be arranged directly with the artist.
7. Complaints (Warranty)
According to Danish law, you have a 2-year right to complain about defects. Complaints must be addressed directly to the artist, as Kunstsamlingen is not part of the transaction.
8. Confidentiality Policy
Kunstsamlingen and the artist respect your privacy. Personal data is only used to complete the purchase and will never be sold to third parties.
9. Disclaimer of Liability
Kunstsamlingen does not buy or sell artworks and cannot be held liable for agreements, payments, deliveries, or disputes between artist and buyer. Our role is strictly as a facilitator of contact and presentation.

2. Where do we store your information?
Your data is stored within the European Economic Area (EEA) but may also be transferred to countries outside the EEA in compliance with applicable laws. Standard contractual clauses and safeguards are used for countries without an EU adequacy decision.
3. Who has access to your information?
Your information may be shared within Kunstsamlingen. We never sell, trade, or exchange your personal information to third parties for marketing outside Kunstsamlingen. Third-party data sharing is only to serve you.

Data includes contact info, payment info, order history, and account details. Access is limited to service providers, artists fulfilling orders, and payment providers. Processing is necessary to provide proper service and delivery. Data is retained as long as you are an active customer.
7. Protection of personal information in direct marketing
We use personal data for sending promotional offers, surveys, and invitations. Data includes contact info, gender, and interactions with products or offers. If you have an account, additional data includes name, address, age, and website navigation. You may opt out of marketing via instructions in emails or account settings. Data is retained for marketing purposes until consent is withdrawn.
8. Protection of personal information for member accounts
We use your data to manage your account and provide personalized experiences, including order history, account preferences, product recommendations, and saved shopping items. Data includes contact info, encrypted credit card info, order history, and browsing data. Data is processed based on your consent and retained while your account is active. You can close your account at any time, which will delete your data, unless legal obligations apply.
9. Protection of personal information in competitions
Data is used to run competitions, identify participants, verify age, contact winners, and deliver prizes. Data includes contact info, age, and competition submissions. Access is limited to organizers and delivery services. Processing is based on consent and data is retained for 45 days after the competition ends.
10. Improving services
We use pseudonymized data to improve services, analyze usage, optimize interfaces, recommend products, and plan new galleries. Data includes customer numbers, orders, deliveries, payment info, and cookie data.
11. Legal obligations
We process data to comply with laws, accounting regulations, and authority requirements. Data includes customer numbers, orders, transactions, and addresses. Access is limited to internal departments and IT service providers.
12. Prevention of misuse and crime
Data is used to prevent abuse, ensure compliance, detect fraud, and for video surveillance. Data includes contact info, customer numbers, video recordings, and order history. Third parties include insurers and authorities. Video recordings are retained up to 30 days.
13. Sub-processors
Sub-processors include Simply A/S (server hosting), Epay (credit card), and InMobile ApS (SMS). Additional partners may process data for accounting, payments, and bank services.
14. Cookies
A cookie is a small text file stored on your device to gather information for future visits. Using our services implies acceptance of cookies.
